Information on the Herrenberg ruling

The Herrenberg judgement of the Federal Social Court from 2022 classified a music school teacher working on a fee-paying basis as an employee, leading to changes in the assessment criteria for status determination proceedings and increased legal uncertainty for educational institutions. To temporarily resolve these legal uncertainties, a transitional provision regarding social security contributions for self-employed teaching activities under Section 127 of Book IV of the Social Code has been extended until the end of 2027. See: www.gesetze-im-internet.de/sgb_4/__127.html

We have received the following notice from the German Pension Insurance Fund (DRV):

In order to avoid potentially protracted administrative procedures with the German Pension Insurance Fund (DRV) or legal disputes, the DRV recommends that, for the year 2027, explicit consent to the application of the transitional provision under Section 127 of Book IV of the Social Code (SGB IV) be obtained once again. This applies to clients/educational institutions that employ freelance staff. A written statement, i.e. consent sent by email, is sufficient.
The transitional provision does not exempt you from a possible obligation to be covered by pension insurance as a self-employed teacher.

A draft bill on the reform of the status determination procedure – that is, the process of assessing whether a person is self-employed or employed – is expected in autumn 2026.
